Our show next Friday on January 18 has a title which contains the words "Murder" and "Mob". There is another company which performs a show in Manhattan which contains the words "Murdered" and "Mob". They are not the same show - so if you think you are seeing the Manhattan show on January 18, you are not. If you think you are seeing our show by going into Manhattan, you are not. Confused? Don't be.
We do a brand new show each time. Usually our plots are based upon real crimes and murders that have taken place in the past. Our shows have titles but other companies can use the same title. Why? Because it's the law. According to the US Copyright Office FAQ: "How do I copyright a name, title, slogan, or logo? Copyright does not protect names, titles, slogans, or short phrases."
Titles containing the words "Murder", "Murdered" and/or "Mob" have been utilized in countless books, plays, articles and have been utilized in the past by many other companies that operate dinner shows around the country. That is because titles of a single work, whether a book, play, periodical, song, movie, or television program will not be protected under either trademark or unfair competition law because all single title works are considered "inherently descriptive" at best and "inherently generic" at worst. In fact, a trademark search reveals that there is no claimed trademark for the combination of the words "Murder", "Murdered" and/or "Mob" - probably because those words are not federally registrable and/or legally protectable.
If you want to know if a show is a "Killing Kompany® " show, it will have our name on it (which is a US Registered Service Mark -IC 041. US 100 101 107. G & S: Dinner theaters. FIRST USE: 19931113. FIRST USE IN COMMERCE: 19931113).
Oh...by the way, our January 18 show - the title of which we have used several times in the past but of course with different plots - is sold out. Our venue for that show only sits 70 people.
